Terms of Service

Welcome to UltimateProfile.ai (the "Service", "Platform", "we", "us", or "our"), operated by Undetectable Inc. These Terms of Service ("Terms") govern your access to and use of UltimateProfile.ai, including our photo generation tools, Reshoot features, websites, applications, and APIs.

By accessing or using UltimateProfile.ai, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Service.

1. Eligibility & Account Registration

  • Age Requirement: You must be at least 18 years of age to use the Service. By accessing the Service or creating an account, you represent and warrant that you are at least 18 years old.
  • Account Authentication: To access certain features, you must authenticate using Google OAuth or a verified email one-time passcode (OTP). You are solely responsible for maintaining the confidentiality of your credentials and account sessions, and for all activities that occur under your account.
  • Account Information: You agree to provide accurate, current, and complete information during registration and keep your account details updated.

2. Description of Service & AI Output Notice

  • The Service: UltimateProfile provides generative AI tools, fine-tuned personalization models (including custom LoRA weights), and automated photo enhancement features ("Reshoot") engineered to optimize portraits, fix photographic imperfections (such as bad lighting, framing, and closed eyes), and generate dating profile photos.
  • Nature of Generative AI: You acknowledge and agree that generative AI outputs are inherently probabilistic. While our algorithms strive to preserve your natural facial identity, results can vary, and UltimateProfile makes no representation or guarantee regarding specific aesthetic, personal, or romantic success on third-party platforms.

3. User Uploads & Content Ownership

  • Your Content: You retain all ownership rights, copyright, and title in the original photos and likenesses you upload to the Service ("User Content").
  • Limited License to Operate: You grant UltimateProfile and its technical hosting and compute partners a worldwide, non-exclusive, royalty-free, limited license to host, store, analyze, transmit, and process your uploaded photos solely to generate your requested photos, maintain your model weights, and operate the Service.
  • User Representations & Warranties: You represent and warrant that:
    1. You own or have secured all necessary rights, licenses, and releases to submit the photos.
    2. Every photo submitted depicts you, or you have secured express, written authorization from the depicted individual. You strictly agree not to upload photos of minors or non-consenting third parties.
    3. Your uploads do not violate or infringe upon any third party's privacy, publicity, copyright, trademark, or other proprietary rights.

4. Ownership & Commercial Use of AI Outputs

  • Deliverables: Subject to your compliance with these Terms and payment of all applicable fees, you own all right, title, and interest in and to the images generated specifically for your account ("Generated Outputs").
  • Commercial License: Commercial usage rights are granted in accordance with your subscribed plan (e.g., qualifying tiers such as the Ultimate Plan include full commercial usage rights).
  • Watermarked Previews: Any watermarked preview images provided during trial or onboarding phases remain the property of UltimateProfile and may not be publicly distributed, copied, or used until unlocked via a valid paid subscription.

5. Prohibited Activities & Automated Content Moderation

We enforce automated multi-modal safety filters (such as Llama Guard) at ingestion and generation. We maintain a zero-tolerance policy for abuse. You agree not to upload, create, or attempt to generate:

  • Child Exploitation Material (CSAM): Uploading, generating, or attempting to generate CSAM or any material depicting the sexual exploitation of minors is strictly prohibited. Any violation results in immediate account termination, blacklisting, and immediate mandatory reporting to law enforcement authorities, including the National Center for Missing & Exploited Children (NCMEC).
  • Non-Consensual Imagery & Deepfakes: Creating synthetic media of individuals without their explicit consent or generating deceptive non-consensual sexual content.
  • Harassment, Defamation, or Hate Speech: Content depicting extreme violence, self-harm, hate speech, or harassment.
  • System Abuse: Reverse engineering, decompiling, automated scraping, or circumventing platform rate limits, watermarks, authentication barriers, or paywalls.

We reserve the right to review, reject, or purge content and terminate accounts violating these standards without notice or refund.

6. Subscriptions, Trials, & Billing

  • Payment Processing: Payments and subscription billing are processed securely through Stripe. We do not store complete credit card details on our servers.
  • Free Trials: If you enroll in a promotional free trial, a valid payment method may be required. Unless canceled prior to the trial expiration timestamp, your subscription automatically transitions into a recurring paid subscription at the selected cadence (weekly, monthly, or yearly).
  • Recurring Billing: Subscriptions renew automatically at the end of each billing cycle unless canceled before renewal through your account settings or Stripe billing portal.
  • Refund Policy: Due to immediate compute, GPU, and model fine-tuning costs incurred upon photo generation, payments are non-refundable once generation runs or credits have been utilized, except where mandatory by law.

7. Third-Party Services & Cloud Infrastructure

The Service utilizes trusted cloud infrastructure, AI model providers, and hosting vendors (including Cloudflare, fal.ai, Replicate, and Stripe). We are not responsible for downtime, API latency, or service interruptions caused directly by external infrastructure providers.

8. Disclaimer of Warranties

THE SERVICE AND ALL GENERATED ASSETS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL UNDETECTABLE INC., ULTIMATEPROFILE.AI, OR ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR REPUTATION. OUR AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO ULTIMATEPROFILE.AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Modifications & Termination

We reserve the right to modify these Terms at any time. We will indicate revisions by updating the "Last Updated" date. We reserve the right to suspend or terminate access for any user who violates these Terms or threatens service security.

11. Governing Law & Contact

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
